Welcome to GAINSTAPE. These Terms of Service ("Terms") govern your access to and use of our website and your purchase of products from us. By accessing our site or placing an order, you agree to these Terms. If you don't agree, please don't use the site.

1. Who we are

2. Eligibility

3. Products, pricing, and availability

We sell a body tape measure and related items. We work to display our products and prices accurately, but errors can occur. We reserve the right to correct any errors, change prices, and cancel or limit orders (including after an order has been placed) if a product is listed at an incorrect price or is unavailable. Prices are in US dollars. Promotional pricing is valid only for the stated period.

4. What GAINSTAPE is — and isn't

GAINSTAPE is a measurement tool for tracking body measurements over time. It is not a medical device, and nothing we sell or say is intended to diagnose, treat, cure, or prevent any condition, or to provide medical, fitness, or nutritional advice. The product does not change your body; it helps you record measurements. Any results you track depend on your own training, nutrition, and consistency. Consult a qualified professional before beginning any fitness or nutrition program.

5. Orders and payment

When you place an order you're making an offer to purchase, which we accept when we process your payment and/or ship your item. You authorize us and our payment processors to charge your selected payment method for the total shown at checkout, including any taxes and shipping. We use third-party processors (such as Shopify Payments and Shop Pay) and don't store your full payment card details ourselves.

6. Shipping and returns

Shipping timelines, regions, and delivery estimates are described in our Shipping Policy. Returns, refunds, and our 30-day satisfaction guarantee are described in our Refund Policy. Both are incorporated into these Terms by reference.

7. Discount codes and promotions

Discount codes are for legitimate customer use only, may be limited in time and quantity, can't be combined unless stated, and have no cash value. We may cancel or refuse orders that misuse, resell, or abuse promotional codes.

8. Acceptable use

You agree not to use our site for any unlawful purpose, to interfere with its operation or security, to scrape or copy content without permission, or to submit false or fraudulent orders. We may refuse service, cancel orders, or restrict access at our discretion.

9. Intellectual property

All content on this site — including the GAINSTAPE name, logo, text, images, and design — is owned by us or our licensors and is protected by law. You may not copy, reproduce, or use it for commercial purposes without our written permission.

10. Reviews and submissions

If you submit a review, photo, or other content, you grant us a non-exclusive, royalty-free right to use, display, and reproduce it in connection with our business. You're responsible for the content you submit and confirm it's truthful and yours to share.

To the fullest extent permitted by law, we disclaim all warranties not expressly stated, including implied warranties of merchantability and fitness for a particular purpose. We don't guarantee that the site will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, GAINSTAPE will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the site or products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.
